Business Civil Liability insurance
Business Civil Liability
Cover for your civil liability for damage caused to third parties during the operation of the insured activities.
Insured damage:
- Physical damage
- Material damage
- Non-material consequential loss
- Purely non-material damage
extended to: damage caused by, among other things:
- Fire, flames, smoke, explosion and water
- Accidental environmental damage
- Nuisance from neighbours (art. 544 of the Civil Code)
- Subcontractors (personal liability remains excluded).
Entrusted Goods
Cover for your civil liability for damage to goods entrusted to the insured for work.
Insured damage:
• Material damage
• Non-material consequential loss
Civil Liability After delivery or after completion of works
covers the contractual and extra-contractual civil liability of the insured company for damage to third parties caused by products after delivery or by works after their completion, within the framework of the declared activity.

Professional indemnity insurance
What is insured?
Damage to your client or others that occurs as a result of a professional error committed by you. Incorrect advice that you have given is also covered. Your insured sum is stated on the special conditions attached to the policy.
Who are insured?
In addition to your company, errors by your employees, temporary staff, interns and volunteers are also insured. A company that you engage to do something for you is also covered.
Legal help
The costs of legal assistance, criminal proceedings or disciplinary proceedings are insured.
These costs are only reimbursed if the damage is insured and we have given permission for the costs to be incurred.
Option: run-off cover
Does someone hold you liable after terminating the insurance for a professional error made before the end date? Then that is insured.
Office risk
With this insurance policy, you are insured when you are held liable for damage caused by you or your employees.
With this cover, you are insured if someone holds you liable for damage to their belongings that you or your employee has caused.
Option: Business Civil Liability, Entrusted Goods, Legal Assistance
Optionally, Business Civil Liability insurance, Entrusted Goods insurance and/or Legal Assistance insurance can be added to the policy.
Option: Retroactive cover
If someone holds you liable for a professional error committed before taking out this policy, then you are insured for this, insofar as you were not already aware of this professional error.
The term of retroactive cover and the insurance premium for this are determined upon taking out the contract.
Option: Cyber
An optional Cyber insurance policy can be linked to certain Professional Indemnity policies.
The insured limit, conditions and premium are determined upon taking out the contract. This cover can only be added under certain conditions and for certain professions.

Main exclusions common to all guarantees
- Intent or serious misconduct, as set out in the General Terms and Conditions
- Fines
- Damage caused by acts of war, lockout, riot, terrorism or sabotage
- Damage caused by the presence or spread of asbestos
- Professional Indemnity
Main exclusions in Business Civil Liability
- Damage caused by delay, non-performance or poor performance of contractual obligations
- Objective liability in the event of fire or explosion
- Damage resulting from the liability referred to in the Act on compulsory insurance for motor vehicles
Main exclusions from the cover of entrusted goods
- Loss or damage due to theft, disappearance or shortage
- Damage to goods manufactured, sold or delivered by the insured company or its subcontractors, in the event of the installation of these goods
- Purely non-material damage
Main exclusions in Civil Liability after delivery
- Damage to defective products or works
- Ineffectiveness, purely non-material damage
- Pure inefficiency
- Costs for withdrawal and investigation
- Costs for removal, relocation, replacement, repair or reimbursement
Professional indemnity insurance
Damage caused intentionally or that occurs as a result of a crime is not insured.
Cost overrun
This insurance does not cover the damage in connection with exceeding cost budgets and delivery dates.
Intent, fraud and property crimes
Damage caused intentionally, or which is the result of fraud or property crimes such as theft, fraud or forgery.
Retroactive cover
Does someone hold you liable after the start date of the insurance for an error that you committed before the start date? Then that is not insured.
Retroactive cover can optionally be insured under this policy.
Director's liability
Liability in one’s capacity of director or supervisory director is not covered. Re-delivery of a product or service, damage or costs incurred to subsequently deliver the service are not covered.

It is essential that you review these documents before giving your approval to the financial product or signing it. The documents are available via the above links or can be requested from our office.

The insurance contract is governed by Belgian law.
Origin of the product developer: product offered by Zurich Insurance Plc, Belgian Branch, Da Vincilaan 5, 1930 Zaventem.
Location where you can get a quote together with a calculation of the premium: Insurance Office Van Dessel NV, Misstraat 112, 2590 Berlaar.
The term of the product is one year. After the end date, your policy will be tacitly renewed for one year at a time, unless you (notice period of 2 months) or we (notice period of 3 months) cancel the policy by registered mail, by bailiff's writ or by delivery of the termination letter against receipt, subject to compliance with the aforementioned notice period.
Any complaint regarding this offer or the insurance contract can be addressed to the internal complaints department of Insurance Office Van Dessel NV, Misstraat 112, 2590 Berlaar, info@vandessel.be.
If you disagree with the outcome of the complaint handling, you can submit a complaint to the VZW Insurance Ombudsman, square de Meeûs 35, 1000 Brussels Tel No: 02/ 547 58 71; Fax No: 02/ 547 59 75; info@ombudsman-insurance.be; www.ombudsman-insurance.be. Complaints must be submitted in writing. Submitting a complaint does not affect the policyholder's right to take legal action.
